HR Complaint Investigation Workshop

Federal and State Equal Employment Opportunity (EEO) laws, such as Title VII of the Civil Rights Act of 1964 (Title VII), the Age Discrimination in Employment Act (ADEA), and the Americans with Disabilities Act (ADA), prohibit discrimination and harassment in employment based on an individual's race, sex, color, national origin, religion, age (40+), disability, and prior protected EEO activity.

Federal and State agencies may investigate EEO allegations brought by employees under the laws, and concerned employees also may file EEO lawsuits, if specific considerations are met.  Therefore, an employer will be best prepared to prevent, respond to, and resolve employee EEO concerns if it has a clearly defined and applied EEO policy and complaint investigation process.

This workshop provides an orientation to relevant legislation, case law, guidelines, policies and forms for the effective prevention, response and resolution of EEO Issues and gives examples of how an employer can use an appropriate policy, investigation process, and interview techniques to achieve the most positive outcomes.

Expected Outcomes:
This training will provide in-depth background and preparation for understanding EEO issues and conducting complaint investigations.  Lecture, discussion, problem-solving, and peer-partner techniques will be utilized to support participant learning.  Participants will gain information and practice in:

  • Understanding Title VII, the ADEA, and the ADA
  • Strategies to prevent, assess, and investigate potential EEO issues
  • Using effective internal EEO policies and procedures for complaint processing
  • Closing complaints and presenting findings

Who should attend?
This workshop is designed for employee relations specialists, HR generalists, attorneys, business owners or others who may need to investigate human resource complaints in the work environment.  Prior human relations training is helpful but not required.

Presenters: Mary L. Sebek has been in private practice since 1989 as an investigator, trainer, consultant, and expert witness in all aspects of equal employment opportunity law.  From 1976 - 1989, Ms. Sebek worked as an Administrative Judge for the U.S. Equal Employment Opportunity Commission and for the U.S. Merit Systems Protection Board, as a Division Chief for the U.S. Court of Appeals for the Ninth Circuit, as an Adjunct Professor of Law for the IIT - Kent College of Law, and as a Trial Attorney, both in private practice and for the U.S. Department of Justice.

Ms. Sebek received her Law Degree, magna cum laude, from the DePaul College of Law, and her Bachelor's Degree, with distinction, from Purdue University.  She has been recognized by the U.S. Equal Employment Opportunity Commission, the State of Washington, and various other federal and local agencies.  She is listed in Who's Who in Sexual Harassment and featured in the CRM video, "Subtle Sexual Harassment." 

Keith Harkless is the Director of Employment Practices and Labor Relations for the J.R. Simplot Company.  Keith joined J.R. Simplot in 1981 after graduating from Purdue University and has held a variety of positions throughout the Company.  Keith has managed the Employee Complaint Department since 1995 and has provided direction, guidance, and assistance in resolving internal employee complaints throughout the company.  Keith has developed and conducted numerous classes and seminars on performing effective complaint investigations and making the complaint process work for managers.  In addition, he has participated in conducting complaint investigation training provided by Boise State University and the Idaho State Bar.

Fees: $879 per person, includes all materials.

Cancellations:
If you cancel at least 48 hours prior to the first class we will refund the tuition minus a $25 processing fee.  If you do not cancel at least 48 hours prior to the first class, the participant or organization will be held responsible for the full fee.
